Christmas Tree Code Violation
Just when I think I’ve seen everything, an inspector sends me a picture she took after someone complained about a code violation. In keeping with the season, I am sharing it with all of you to see if anyone can think of what the charge would or should be.
I guess if pushed, our jurisdiction could write a $50 ticket for scattered debris. From the looks of the vinyl siding, cheap, big-box fencing, and boxy, drab architecture of the house in the background, the complainant lives in a newer subdivision. I’m no physician, but I would guess the complainant suffers from AFFLUENZA. One of the symptoms is increased ocular capabilities which enable them to read between the lines of their subdivision covenants. Another symptom is sporadic hallucinations where Code officers appear to have capes and superpowers to quash any property faux-paus. The final symptom is the obvious yellow streak down their spine where they can’t just go confront their neighbor and tell them they don’t like their display.
I laughed as hard at your comment as I did at the picture. Actually, I hear the violation was for accumulation of rubbish.

No permit for nonapproved landscaping variattions and providing a nuisance as a landing harborage for non indigenous, cloven hoof, aerial mammals without TSA, DHS, or NASA clearence.
OK, I think that Linda should accept photos for the gaudiest holiday display on private property this week. Winner gets one of her publications. What do you say Linda?
I’m game.
It’s obviously not plumb and, therefore, the owner would be cited for not installing the decorative vegetation in a neat and workmanlike manner.
307.1 – Accumulation of rubbish and garbage. (2006 IPMC)- For the bottles and boxes as well as cups. If you look real carefully, you will also see a light fixture to the right of the tree that probly came off the house, add that to the same code.
302.5 Rodent harborage. – for the tree
604.3 Electrical system hazards – for the exposed wires where the outdoor light fixture used to be. (not in photo).
Have a Merry one and be careful out there.
I would like to applaud the property owner for his green efforts to keep all of those glass and aluminum containers out of the local landfill as well as provide habitat for local wildlife. As code officials, we must tread very lightly here. To some people, alcohol is a very integral part of the Christmas season. We don’t want to be accused of interfering with their choice of rituals with which they observe a religious event.
I just love your post and am still laughing.
